1. What is the purpose of the Climate Innovation Challenge? 

The four largest ski area operators have come together to fight climate change.   We realize that combining forces amplifies the impacts we can have.   We also know that we don’t have all the answers, or even all the questions, so we are asking the public to help us identify opportunities where our collective interests can be leveraged.

2.  What are the Terms and Conditions for submitting ideas for the Climate Innovation Challenge? 

The terms and conditions under which ideas can be submitted are found below- please scroll down to read them all.

 

3.  Does the Climate Innovation Challenge Offer a Prize if My Idea is Selected for Further Exploration? 

No.  This is not a contest. There are no “winners.” However, if we choose to collaborate on your idea, you will have the satisfaction of knowing that you made a difference in the fight against Climate Change!

4.  Is the Climate Innovation Challenge a grant?

No. It is a more of a “suggestion box” by which we are looking for collaboration ideas to amplify positive impacts in the sustainability space. Think of it as a virtual ideation session.

5.  How Will Projects Be Chosen? 

Ideas that, in the sole opinion and discretion of the MCCA, best leverage the member’s organizations and partnerships to the greatest impact, will be chosen for further exploration and analysis.

6.  How Many Projects Will Be Chosen? 

We don’t really know!  There is no specific goal in this regard and the amount, quality, feasibility, and impact of submission will determine the next steps.  Collaborators and their proposed contributions will be case-specific and it is our hope that multiple projects can be implanted simultaneously.

7.  May I Submit Multiple Entries? 

While we don’t prohibit multiple entries, we urge to you focus on the one you think has the best chance of catching our attention.

8. How Will I Be Notified if Chosen? 

Within 6 weeks of the first deadline for submissions, we will contact you by the method identified in your submission.

These “Terms and Conditions” are entered into by and between You and The Mountain Collaborative for Climate Action, Vail Resorts, Alterrra Mountain Company, Powdr Corporation, and Boyne Resorts (individually and collectively, "MCCA," "we," or "us"). The following Terms and Conditions  govern your participation in the Mountain Collab Innovation Challenge (“Challenge”).

  1. Please read these Terms and Conditions carefully before you participate in the Challenge. By participating in the Challenge you accept and agree to be bound and abide by these Terms and Conditions and our Privacy Policy, incorporated here by reference . If you do not want to agree to these Terms and Conditions, you must not participate in the Challenge.

  1. This Challenge is offered and available to individuals who are 18 years of age or older, and reside in the United States or any of its territories or possessions. By entering the Challenge, you represent and warrant that you are of legal age to form a binding contract with the Company and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not participate in the Challenge.

  2. We may revise and update these Terms and Conditions from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued participation in the Challenge following the posting of revised Terms and Conditions means that you accept and agree to the changes.

  3. The purpose of the Challenge is to find ideas that can be pursued to create specific actions, projects, or initiatives by the MCCA and/or partners it chooses. In consideration of the mutual covenants and agreements set forth herein and for other good and valuable consideration, including the opportunity to participate in the Challenge, the receipt and sufficiency of which are hereby acknowledged, You irrevocably assign, transfer, convey, and quitclaim to Company, and its successors and assigns, all of Your right, title, and interest of every kind and nature in and to the ideas, concepts, information, and documentation related to any submission you make to Company or related to the Challenge  ("Acquired Rights"). The Acquired Rights include without limitation any:

    1. Copyrights, patents, trademarks, trade names, and service marks, together with the goodwill of the business connected with the use of, and symbolized by, such marks, whether registered or unregistered, and any exclusive copyright licenses;

    2. issuances, extensions, and renewals of any registrations and applications related thereto; and

    3. Your other rights, privileges, and protections of any kind whatsoever accruing under any of the foregoing provided at law or in equity throughout the world.

You acknowledge and agree that You are assigning, transferring, and conveying whatever interest You have or may have in the Acquired Rights, if any, without any representations or warranties of any kind.

  1. From and after the date hereof, You agree to take such steps and actions, and provide such cooperation and assistance to Company and its successors, assigns, and legal representatives, including the execution and delivery of any affidavits, declarations, oaths, exhibits, assignments, powers of attorney, or other documents, as may be necessary to carry out the provisions hereof and give effect to the transactions contemplated by these Terms and Conditions.

  2. These Terms and Conditions constitute the sole and entire agreement of the parties with respect to the subject matter contained herein, and supersedes all prior and contemporaneous understandings and agreements, both written and oral, with respect to such subject matter. These Terms and Conditions may only be amended, modified, or supplemented by an agreement in writing signed by each party hereto, or as otherwise detained herein.

  3. If any term or provision of these Terms and Conditions is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of these Terms and Conditions or invalidate or render unenforceable such term or provision in any other jurisdiction.

  4. These Terms and Conditions shall be binding upon and shall inure to the benefit of the parties hereto and their respective successors and assigns.

  5. All matters arising out of or relating to these Terms and Conditions shall be governed by and construed in accordance with the internal laws of the State of Utah without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of or relating to these Terms and Conditions or the transactions contemplated hereby shall be instituted in the federal courts of the United States of America or the courts of the State of Utah in each case located in the City of Salt Lake and County of Salt Lake, and each party irrevocably submits to the exclusive jurisdiction of such courts in any such legal suit, action, or proceeding.

  6. No waiver by any party of any of the provisions hereof shall be effective unless explicitly set forth in writing and signed by the party so waiving. Except as otherwise set forth in these Terms and Conditions, no failure to exercise, or delay in exercising, any right, remedy, power, or privilege arising from these Terms and Conditions shall operate or be construed as a waiver thereof; and any single or partial exercise of any right, remedy, power, or privilege hereunder shall not preclude any other or further exercise thereof or the exercise of any other right, remedy, power, or privilege
